Terms of Use

Welcome to WellTopo.com, also known as WellTopo! These Terms of Use ("Terms") govern your use of our website at https://www.welltopo.com, our applications, and our services, including our well and septic record-keeping tools, maintenance reminders, water test kit ordering, and water test result dashboards (collectively, the "Service"). The Service is operated by WellTopo ("WellTopo," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.

1. Acceptance of Terms and Eligibility

By accessing or using the Service, you confirm that you can form a binding contract with WellTopo and that you accept these Terms.

  1. Age. You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age.
  2. Authority. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
  3. Region. The Service is operated from the United States and is intended for residents of the United States and Canada. Water test kits can be shipped to addresses in the United States only.

2. The Service

WellTopo provides tools that help homeowners manage residential well, septic, and water systems, including:

  • recording properties of your wells, pumps, water storage, water treatment, and septic systems;
  • keeping maintenance logs and notes;
  • setting maintenance reminders and notifications;
  • ordering water test kits that are fulfilled and analyzed by an independent laboratory partner; and
  • viewing water test results, histories, and trends in a dashboard.

We are continuously improving the Service and may add, change, or remove features at any time. Where a change materially reduces the functionality of a paid feature you have purchased, we will provide reasonable advance notice where practicable.

3. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your information and can be found at https://www.welltopo.com/privacy-policy. The Privacy Policy is incorporated into these Terms by reference.

4. Accounts and Security

  1. Registration. To access certain features of the Service, you must create an account, either with an email address and password or by signing in with your Google account. You agree to provide accurate and complete information when creating your account and to keep your account information up to date.
  2. Security. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at [email protected] of any unauthorized use of your account.
  3. One account per person. Accounts are personal to you and may not be shared, sold, or transferred.

5. Subscriptions, Billing, and Payments

  1. Plans. The Service may offer free features, free trial periods, and paid subscription plans (billed monthly or yearly). The features, prices, and billing intervals of each plan are presented before you purchase.
  2. Payment processing. Payments are processed by our payment processor, Stripe. By making a purchase, you agree to Stripe's applicable terms and authorize us (through Stripe) to charge your selected payment method for the fees and any applicable taxes presented at checkout.
  3. Automatic renewal. Paid subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel before the renewal date. By purchasing a subscription, you authorize recurring charges to your payment method until you cancel.
  4. Cancellation. You may cancel your subscription at any time through the billing portal available in your account (Manage Subscription) or by contacting us at [email protected]. Cancellation takes effect at the end of the current billing period, and you will retain access to paid features until then. Except where required by law, fees already paid are non-refundable and we do not provide prorated refunds for partial billing periods.
  5. Trials. If a plan includes a free trial, the trial converts as described when you sign up — either to a paid subscription at the end of the trial period or to a reduced free feature set if no payment method has been provided.
  6. Price changes. We may change subscription prices. Price changes take effect at your next renewal, and we will provide notice of the change at least thirty (30) days before it applies to you.
  7. Taxes. Prices may be exclusive of taxes. Applicable sales and similar taxes are calculated and presented at checkout.

6. Water Test Kit Purchases and Fulfillment

  1. Fulfillment by laboratory partner. Water test kits purchased through the Service are fulfilled, shipped, and analyzed by our independent laboratory partner, SimpleLab, Inc. (operator of the Tap Score service) and its network of certified laboratories. To fulfill your order, we share your name, shipping address, email address, and phone number with our laboratory partner as described in our Privacy Policy.
  2. Shipping. Test kits are shipped only to addresses within the United States. You are responsible for providing an accurate, deliverable shipping address; we may validate and standardize the address you provide.
  3. Your responsibilities. Collecting and returning your water sample according to the instructions included with your kit is your responsibility. Improper collection, handling, or shipping of samples may delay or invalidate your results.
  4. Turnaround times. Estimated shipping and laboratory turnaround times are estimates only and are not guaranteed.
  5. Refunds. If you need help with an order, contact us at [email protected]. Order cancellations and refunds are handled case by case before a kit ships. Once your sample has been submitted to the laboratory for analysis, the order cannot be canceled or refunded.
  6. Risk of loss. Title and risk of loss for a test kit pass to you upon delivery of the kit to your shipping address.

7. Water Test Results — Important Disclaimers

Please read this section carefully. It addresses the nature and limits of the water testing information available through the Service.

  1. Informational purposes only. Water test results, scores, trends, benchmarks, reminders, and any related guidance presented through the Service are provided for general informational purposes only. They are not, and are not a substitute for, professional advice of any kind — including engineering, plumbing, water treatment, environmental, medical, health, legal, or regulatory advice.
  2. Independent laboratories. Laboratory analyses are performed by independent certified laboratories arranged through our laboratory partner. WellTopo does not itself perform laboratory analysis and does not control laboratory methods, accuracy, or turnaround.
  3. Results are a snapshot. A water test result reflects only the specific sample you collected, at the specific time and place it was collected, as analyzed for the specific analytes included in the kit you purchased. Water quality can change over time and can vary between locations within the same system. A result showing no detected contaminants does not guarantee that your water is or will remain safe to drink.
  4. Reference benchmarks. The Service may display reference values such as federal maximum contaminant levels or health guidance levels. These are provided for context only; they may change, may not apply to private wells in your jurisdiction, and do not constitute a determination that your water complies or does not comply with any standard.
  5. Not compliance testing. Testing ordered through the Service is not certified compliance testing and may not be accepted for regulatory, real estate, lending, or governmental purposes.
  6. Emergencies and health concerns. If you suspect your water is contaminated or has made someone ill, stop drinking it and contact your local health department, a qualified water professional, or a medical professional immediately. Do not rely on the Service for emergency response.
  7. Your decisions. Any decision you make based on information from the Service — including decisions about drinking, treating, filtering, or remediating your water or maintaining your well or septic system — is your own responsibility.

8. Your Content and Data

  1. Your ownership. You retain all ownership rights in the information and content you submit to the Service, including property details, system records, logs, notes, photos, documents, and uploaded test results ("User Content").
  2. License to us. By submitting User Content, you grant WellTopo a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt (for example, to format or normalize data), and display your User Content solely as needed to operate, provide, secure, and improve the Service.
  3. Aggregated and de-identified data. You agree that we may create and use aggregated or de-identified data derived from User Content and test results (for example, regional water quality trends) for any lawful purpose, provided the data can no longer reasonably be linked to you. We will not attempt to re-identify de-identified data.
  4. Responsibility. You are solely responsible for your User Content. You represent and warrant that you have all rights necessary to submit it and that it does not violate any law or the rights of any third party.

9. Acceptable Use

You agree not to engage in any of the following prohibited activities:

  • Violating any applicable laws or regulations.
  • Infringing the intellectual property, privacy, or other rights of others.
  • Uploading or distributing viruses or any other malicious code.
  • Interfering with, disrupting, or attempting to gain unauthorized access to the Service, its servers, or its networks.
  • Scraping, harvesting, or systematically extracting data from the Service, or accessing the Service by automated means without our prior written permission.
  • Reverse engineering, decompiling, or disassembling any part of the Service, except to the extent permitted by applicable law.
  • Impersonating any person or misrepresenting your affiliation with any person or entity.
  • Using the Service to spam or harass others.
  • Reselling or commercially exploiting the Service without our prior written permission.

10. Intellectual Property and Feedback

  1. Ownership. The Service and its original content, features, and functionality are and will remain the exclusive property of WellTopo and its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.
  2. Trademarks. WellTopo and all related Service names, logos, product and service names, designs, and slogans are trademarks of WellTopo. You must not use such marks without the prior written permission of WellTopo.
  3. Feedback. If you send us ideas, suggestions, or other feedback about the Service, you grant us the right to use it without restriction or compensation to you.

11. Third-Party Services

The Service relies on and links to services operated by third parties, including Stripe (payment processing), SimpleLab/Tap Score (test kit fulfillment and laboratory analysis), and Google (sign-in, maps, and address validation). Your use of those services may be subject to their own terms and privacy policies, and we encourage you to review them. We do not control and are not responsible for the acts, omissions, content, or policies of third-party services.

12. Termination

  1. By you. You may stop using the Service and request termination of your account at any time by contacting us at [email protected]. You may cancel a paid subscription as described in Section 5.
  2. By us. We may suspend or terminate your account and access to the Service, with or without prior notice, if you breach these Terms, if your use creates risk or possible legal exposure for us or others, or if required by law. Where reasonable, we will give you notice and an opportunity to cure before terminating.
  3. Effect of termination. Upon termination, your right to use the Service immediately ceases. Information associated with your account is retained and deleted as described in our Privacy Policy.
  4. Survival. Sections that by their nature should survive termination — including Sections 7, 8.3, 10, 13, 14, 15, 16, and 18 — survive termination of these Terms.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WELLTOPO MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WELLTOPO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT WATER TEST RESULTS OR OTHER INFORMATION PRESENTED THROUGH THE SERVICE WILL BE ACCURATE, COMPLETE, OR CURRENT; OR THAT YOUR WATER IS OR WILL REMAIN SAFE TO USE OR DRINK.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW: (A) IN NO EVENT WILL WELLTOPO, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE; AND (B) THE TOTAL AGGREGATE LIABILITY OF WELLTOPO AND THE PARTIES LISTED IN CLAUSE (A) FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (i) ONE HUNDRED U.S. DOLLARS ($100) OR (ii) THE TOTAL AMOUNTS YOU PAID TO WELLTOPO FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.

15. Indemnification

You agree to indemnify, defend, and hold harmless WellTopo, its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your User Content, or your use of the Service.

16. Dispute Resolution and Governing Law

  1. Informal resolution first. Before filing any legal claim against WellTopo, you agree to first contact us at [email protected] with a written description of the dispute and to work with us in good faith for at least thirty (30) days to try to resolve it informally. We will do the same before filing a claim against you.
  2. Governing law. These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law principles.
  3. Venue. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service that is not resolved informally shall be instituted exclusively in the federal or state courts located in Virginia, United States, and you and WellTopo each consent to the jurisdiction and venue of those courts. Either party may instead bring an eligible individual claim in small claims court.
  4. Time limit. To the extent permitted by applicable law, any claim arising out of or relating to these Terms or the Service must be filed within one (1) year after the claim arose; otherwise, the claim is permanently barred.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on the Service and update the "Last updated" date at the top. If a change is material, we will provide reasonable advance notice — for example, by email or by a notice within the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service.

18. Miscellaneous

  1. Entire agreement. These Terms, together with the Privacy Policy and any terms presented at checkout, constitute the entire agreement between you and WellTopo regarding the Service.
  2. Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
  3. No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
  4. Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  5. Force majeure. We are not liable for any delay or failure to perform resulting from causes outside our reasonable control.
  6. Electronic communications. You consent to receive communications from us electronically, including by email and notices within the Service, and agree that such communications satisfy any legal requirement that communications be in writing.
